Your continued use of this web site will be subject to the then-current privacy policy. If deemed appropriate by eStudySite, eStudySite will send changes to this privacy policy to you via e-mail.

Disclaimer of Warranty. ESTUDYSITE PROVIDES THIS SITE “AS IS”, AND DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED AND STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Limit of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ESTUDYSITE HAVE ANY LIABILITY RELATING TO THE SITE OR TO SERVICES OFFERED BY ESTUDYSITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY.

Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESTUDYSITE SHALL NOT BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES OF ANY KIND RELATING TO THE SITE OR TO SERVICES OFFERED BY ESTUDYSITE, EVEN IF ESTUDYSITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous. This privacy policy shall be governed by the laws of the State of California, U.S.A. without regard to conflict of laws principles. The parties agree that any claim shall be brought in the federal and state courts located in San Diego County, California, U.S.A., and both parties hereby submit to the jurisdiction of such courts. If any provision hereof shall be held illegal, invalid or unenforceable, in whole or in part, such provision shall be modified to the minimum extent necessary to make it legal, valid and enforceable, and the remaining provisions of this privacy policy shall not be affected thereby. The failure of eStudySite to enforce any right or provision of this privacy policy shall not constitute a waiver of such right or provision. This privacy policy constitutes the parties’ entire understanding regarding personally identifiable information collected from persons who correspond with eStudySite, and supersedes any and all other prior or contemporaneous agreements, whether written or oral.
